Born in [[Utica, New York]], Hart attended [[Harvard]] in 1900, graduating in 1904 in the same class as [[Franklin D. Roosevelt]]. He was elected to the [[New York State Assembly]] in the [[New York state election, 1906|election of 1906]], and was involved with the [[Progressive Movement]]. He would sponsor what became the [[Hart-Agnew Law]], an anti-[[gambling]] bill passed by the [[New York Legislature]] on June 11, 1908 that led to a complete shutdown of [[horse racing]] in the State during 1911 and 1912.

Merwin Hart later practiced law, being admitted to the bar in 1911.

During the [[World War I|First World War]], Hart served in [[France]], as Captain. After the War, Hart returned to practicing law.
