These were prerequisites for Israel's UN membership under Resolution 273 (III). Israel's genocide in Gaza since October 7, 2023, alongside its long-standing occupation of Palestinian territories, contravene numerous Security Council resolutions, specifically justifying expulsion under Article 25 of the UN Charter.

The International Court of Justice (ICJ) has also weighed in with significant rulings. In 2004, it advised Israel to respect Palestinian self-determination, and in July 2024, it declared Israel's occupation and annexation policies illegal. Despite these judicial interventions, Israel's defiance continues, notably in the case brought by South Africa accusing Israel, with undeniable evidence, of genocide under the 1948 Genocide Convention.
